1. About these terms
These terms apply when you use facadia.com.au and any related pages, including the builder portal (the "Website"). By using the Website you agree to these terms. If you do not agree, please do not use the Website.
2. General information only
Product information, guides, calculators, price guides and technical resources on the Website are general information only. They do not take your project, site or design into account. Always follow the manufacturer's current design and installation guides, your project documents, the National Construction Code and advice from your engineer, building surveyor or other qualified adviser. Calculator outputs are estimates and should be checked before ordering.
3. Prices and availability
Prices are shown in Australian dollars, ex GST, with the GST-inclusive price beside them. Prices, stock and product details can change without notice. An order is only accepted when we confirm it in writing. Sales are governed by our Terms and Conditions of Sale.
4. No account needed, job links and the builder portal
You don't need an account or password to use the Website or to order. Guests order with their name, phone and email, and must give accurate details.
Each quote or order gets a private job link that we email to you. Keep it private: anyone with the link can view that job. If you think your link has been shared, tell us and we'll reset it.
The builder portal is optional. It is opened by a link we email you, with no password. You are responsible for content you or people you invite (such as installers) upload, including photos, SWMS, pre-starts and job details. You must have the right to upload it, and it must not be unlawful, misleading or infringe anyone's rights.
Portal templates (including SWMS and pre-start templates) are general templates only. The person conducting the business or undertaking (PCBU) and the installer must review them, adapt them to the site and the work, and consult workers. To the extent permitted by law, Facadia takes no responsibility for how templates are used or adapted. We may suspend or reset job links or portal access used in breach of these terms.
5. Licence to your content
You keep ownership of the content you upload. You give us a non-exclusive, royalty-free licence to store, use and display that content to run the portal and provide our services, and to use de-identified or aggregated data to improve and promote our services. We handle personal information under our Privacy Policy.
6. Intellectual property
The Website, its design, text, graphics, logos and software are owned by or licensed to Facadia. You may view and print pages for your own business or personal use. You must not copy, reproduce or commercially use them without our written permission. Manufacturer names and trade marks belong to their owners.
7. Acceptable use
You must not misuse the Website, including by attempting to gain unauthorised access, introducing malicious code, scraping data, interfering with its operation, or using it for any unlawful purpose.
8. Third-party links
Links to manufacturer and other third-party sites are for convenience. We do not control and are not responsible for their content.
9. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, that you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, we provide the Website "as is", we do not guarantee it will be uninterrupted or error-free, and to the extent permitted by law we are not liable for any loss arising from use of, or reliance on, the Website or its content, including indirect or consequential loss.
10. Changes
We may update these terms at any time by publishing a new version on the Website. Continued use means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
