1. Application
These terms apply to every quote, order and sale of goods by Facadia, and override any terms in your documents unless we agree otherwise in writing. Placing an order, or paying for goods, means you accept these terms.
2. Supply only
Facadia supplies goods only. We do not design, engineer, install or supervise installation, and we do not take responsibility for the work of any builder, installer or other trade, including installers you find through our website or network. Choosing a suitable product for your project, and installing it in line with the manufacturer's current guides, your project documents and the National Construction Code, is the responsibility of you and your builder, installer and designers.
3. Quotes and orders
Quotes are valid for 14 days unless stated otherwise and are based on the information you give us (including plans and take-offs). Please check quantities, sizes and products before you order. Quantities from our online calculator or materials estimate are calculated from the details you enter. You're responsible for checking quantities and allowing for cuts, openings and waste. We supply what you order. An order is accepted only when we confirm it in writing. We may decline any order.
4. Prices
Prices are in Australian dollars. Prices are shown ex GST with the GST-inclusive price beside them, and GST is shown on your invoice. Delivery is quoted separately and confirmed before you pay.
5. Payment
Payment is by bank transfer per the invoice terms. Full payment is required before goods are dispatched or collected. Goods are not reserved until paid.
6. Delivery
- Delivery for all products is quoted separately on confirmation, based on location, quantity and site access. We send one invoice for goods and freight, to be paid before dispatch. Lead times may vary by manufacturer. We'll confirm your expected delivery date on your invoice.
- Delivery dates are estimates. We will keep you informed, but we are not liable for delays outside our reasonable control (including weather, supplier or transport delays).
- You must make sure the site has safe, clear and lawful access for the delivery vehicle (including crane or Hiab trucks), a firm, level set-down area, and someone available to receive the goods where required. Goods will not be placed on footpaths, nature strips or public areas.
- If delivery cannot be completed because of site access, safety or no one being present, we may charge for a return trip, redelivery or storage.
- Freight quotes and extra charges. Your freight quote relies on the information you give us about the site, including access, whether scaffold is up and any crane lift height. If conditions on the day are different, we may charge extra at our standard rates for waiting time on site, a delivery that can't be completed and has to be rebooked, extra crane time (including lifts onto scaffolding or upper levels taking longer than booked) and other changes in site conditions. We'll tell you before any extra work goes ahead where we can.
- You're responsible for safe, clear access to the site and the set-down area for the delivery vehicle and any crane or Hiab.
- Delivery is complete when the goods are unloaded at the site set-down area or collected from us.
7. Inspection on delivery
Please inspect goods on delivery and note any visible damage or shortage on the delivery docket, with photos, and tell us within 48 hours. Do not install goods that are visibly damaged.
8. Risk and title
Risk in the goods passes to you on delivery. Ownership (title) passes to you once we have received full payment.
9. Returns
Returns are handled under our Returns and Refunds Policy, which forms part of these terms.
10. Manufacturer warranties
Many products carry a manufacturer's warranty. Those warranties are given by the manufacturer and depend on its conditions, including installation in line with its current guides. We will pass on manufacturer warranties to the extent we can and help you make a claim.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If you are a consumer, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies those rights.
12. Limitation of liability
To the extent permitted by law: - where goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to meet a consumer guarantee is limited to (at our choice) replacing the goods, supplying equivalent goods, or paying the cost of replacing or repairing them; - we are not liable for any indirect or consequential loss, loss of profit, delay costs, labour or installation costs, or any loss caused by incorrect selection, storage, handling or installation of goods by others; and - all other warranties and conditions not set out in these terms are excluded.
13. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control.
14. Privacy
We handle personal information in line with our Privacy Policy.
15. General
If any part of these terms is invalid, the rest continues. Our failure to enforce a term is not a waiver. These terms are governed by the laws of Victoria, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
